DMCA Policy

The Digital Millennium Copyright Act (DMCA) is a 1998 United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). It criminalizes production and dissemination of technology, devices, or services intended to circumvent measures that control access to copyrighted works (commonly known as digital rights management or DRM). It also criminalizes the act of circumventing an access control, whether or not there is actual infringement of copyright itself. In addition, the DMCA heightens the penalties for copyright infringement on the Internet. Passed on October 12, 1998, by a unanimous vote in the United States Senate and signed into law by President Bill Clinton on October 28, 1998, the DMCA amended Title 17 of the United States Code to extend the reach of copyright, while limiting the liability of the providers of online services for copyright infringement by their users. The DMCA's principal innovation in the field of copyright is the exemption from direct and indirect liability of Internet service providers and other intermediaries. This exemption was adopted by the European Union in the Electronic Commerce Directive 2000. The Information Society Directive 2001 implemented the 1996 WIPO Copyright Treaty in the EU.

Digital Millennium Copyright Act (DMCA) Policy Overview

We (SamuLighting.Inc.) respect and comply with all applicable copyright laws and provide indemnity against claims of copyright infringement.

All notifications of alleged infringement should be sent to our Designated Agent. Upon receipt of a notification of alleged infringement, we will follow the procedures outlined on this page and in the Digital Millennium Copyright Act (DMCA). Complaints submitted to the Designated Agent will be forwarded to SamuLighting's Content Manager.

SamuLighting Repeat Infringer Policy

1. Policy Statement

SamuLighting firmly opposes and will not tolerate any infringement of copyrights or intellectual property rights of SamuLighting or others.

2. Termination of Access and Use Privileges

SamuLighting reserves the right to terminate the access and/or use privileges of any person determined to be a "repeat infringer" of SamuLighting's or others' copyrights.

3. Definition of "Repeat Infringer"

Standard-Setting Authority: SamuLighting reserves the right to define its criteria for determining whether an individual is a "repeat infringer."

General Rules (Not Limited to SamuLighting's Standard-Setting Authority): In general, SamuLighting defines a "repeat infringer" as any person or entity from whom SamuLighting has received two or more Digital Millennium Copyright Act (DMCA) notifications of alleged infringement.

Final Decision: SamuLighting will consider all relevant facts and circumstances in determining whether it is appropriate to terminate the access and/or use privileges of a "repeat infringer."

4. Retention of Rights and Remedies

Legal Recourse: Regardless of whether SamuLighting terminates the access and/or use privileges of any person or entity (whether a "repeat infringer" or otherwise), SamuLighting does not waive its right to pursue any available legal or equitable remedies against the copyright infringer or any other intellectual property violator.

No Liability or Legal Representation: SamuLighting will not indemnify or provide legal representation to any alleged infringer in any action arising out of the alleged infringer's use of any SamuLighting website or service, except as expressly provided in this Notice.

Complaint Notification Procedure for Copyright Owners

Notices of alleged copyright infringement must include the following information:

An electronic or physical signature of the copyright owner or the person authorized to act on their behalf.

Identification of the copyrighted work claimed to have been infringed; if multiple works at a single online site are covered by a single notification, a representative list of such works is required.

Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate that material and remove it or disable access to it.

Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address.

A statement that the complaining party has a good faith belief that use of the material complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is the copyright owner or a person authorized to act on the copyright owner's behalf, and that the copyright or exclusive right that has allegedly been infringed.

Failure to include all of the above information may delay the processing of the DMCA notice.

  • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., fair use).
  • "I hereby state that the information in this notification is accurate, and under penalty of perjury, that I am the copyright owner or a person authorized to act on the copyright owner's behalf, and that the copyright or an exclusive right that has allegedly been infringed is infringed."
